Agreement

These Terms govern your use of Maito (maitoai.com), operated by MaitoAI, LLC, a Delaware company located at 1111b South Governors Ave STE 25502, Dover, DE 19904, United States.

By creating an account or using the Service, you agree to these Terms on your own behalf. If you use Maito for a brand, client, or business, you represent that you are authorized to do so.

The Service

Maito provides a web-based service for writing, editing, scheduling, and publishing social posts. You can connect your social accounts, create drafts, get AI-assisted writing support, organize scheduled posts, and publish from one place. We handle orchestration, queueing, and delivery to the connected platforms you choose.

Accounts

Maito accounts are currently personal accounts. You are responsible for activity that occurs under your account and for keeping your login credentials and connected social accounts secure.

You must be at least 13 years old to use Maito. If you are under 18, you need parental consent.

Pricing and Payment

Maito currently offers a single paid subscription plan priced at $39 per month, unless we say otherwise at checkout or on our pricing page. We may change pricing, features, or plan structure in the future.

Subscriptions renew automatically each month. You can cancel anytime from your dashboard. Cancellation stops future charges but does not refund the current billing period.

Payments are processed by Stripe. Prices do not include taxes, which may be added based on your location.

Third-Party Platforms

Maito integrates with third-party platforms, including X and LinkedIn, so you can publish posts on your behalf. You are responsible for the accounts you connect and for complying with each platform's terms, policies, and rules.

We are not liable for platform outages, account restrictions, rate limits, moderation decisions, or policy changes made by those platforms.

AI Features

Some Maito features use third-party AI providers, including OpenAI, to suggest, rewrite, summarize, or draft content. We may change or add providers over time.

AI-generated suggestions may be inaccurate, incomplete, or unsuitable for your audience. You are responsible for reviewing and approving content before you save, schedule, or publish it.

Your Content

You own the posts, drafts, images, captions, and other content you create or upload through Maito, subject to any rights held by third parties.

You grant us permission to process your content as needed to provide the Service, including storing, formatting, analyzing, scheduling, and publishing it at your instruction. We do not use your content to train our own models or for marketing without your permission.

You are responsible for having the rights to any content you upload, including text, images, logos, names, and likenesses.

Drafts and Storage

Drafts, connected-account metadata, publishing history, and related assets can be stored on Maito's infrastructure for as long as needed to operate your account, unless you delete them, close your account, or ask us to remove them. We may retain certain data longer for legal, security, backup, fraud-prevention, or billing reasons.

Acceptable Use

Do not use Maito to:

  • Post illegal content or content that exploits minors
  • Impersonate people or mislead audiences without authorization
  • Produce harassment, hate speech, or content inciting violence
  • Infringe copyrights, trademarks, or other rights
  • Abuse platform integrations, circumvent security measures, or automate spam
  • Resell access to the Service without authorization

We may suspend or terminate accounts that violate these rules.

Platform and AI Limitations

X, LinkedIn, AI providers, and other third-party services may delay, reject, rate limit, alter, or fail to process content, and their rules can change without notice. Do not rely on the Service for guaranteed, error-free, or real-time delivery.

Availability

We work to keep Maito available but cannot guarantee uninterrupted service. Maintenance, third-party platform issues, queue delays, or unforeseen problems may cause downtime or publishing delays.

Intellectual Property

Maito's software, documentation, and branding belong to us. You may use the Service under these Terms. You may not copy, reverse engineer, resell, sublicense, or exploit our software except as permitted by law.

Copyright Claims

If you believe content on Maito infringes your copyright, email [email protected] with details of the work, location of the infringing content, and your contact information.

Liability

Maito is provided "as is" without warranties. We disclaim all implied warranties including merchantability and fitness for a particular purpose.

We are not liable for indirect, incidental, or consequential damages, including losses from delayed, failed, or rejected publishing actions, account restrictions, or AI-generated output. Our total liability is limited to the amount you paid us in the 12 months before the claim arose.

These limitations do not apply where prohibited by law.

Indemnification

You agree to indemnify us against claims arising from your content, your use of the Service, or your violation of these Terms.

Termination

You can close your account anytime. We may suspend or terminate accounts for violations, non-payment, or if required by law. On termination, your right to use the Service ends, but provisions that should survive (like liability limits) will continue. If you want an export of your data before account closure, contact support and we will make commercially reasonable efforts to help.

Changes

We may update these Terms from time to time. If we make material changes, we may notify you by email, through the Service, or by updating the date at the top of this page. Continued use after the changes take effect means you accept the updated Terms.

Legal

These Terms are governed by Delaware law. Disputes will be resolved in Delaware courts.

If any part of these Terms is unenforceable, the rest remains in effect. These Terms are the complete agreement between you and Maito.

You cannot transfer your rights under these Terms without our consent. We may transfer ours in connection with a company sale or reorganization.
